McDonald's has filed an appeal against an EU Intellectual Property Office (EUIPO) revocation of its Big Mac trademark.

The trademark was revoked after Irish fast food chain, Supermacs, attempted to register the term Big Mac in classes 29, 30, and 42. McDonald’s opposed, but failed.

The EUIPO’s cancellation division ruled that McDonald’s had failed to “[prove] genuine use of the contested EU trademark for any of the goods and services for which it is registered” and revoked the mark.

Supermacs had argued that McDonald’s is engaged in "trademark bullying; registering brand names which are simply stored away in a war chest to use against future competitors”.

A McDonald’s spokesperson said they were confident that in the event of an appeal the decision would be overturned by the EUIPO Board of Appeals.
