“Huawei Phoenix” Scientific Instrument Trademark Registration Is Rejected

On January 6, according to software provider company Tianyancha App, the decision to review the refusal of the No. 49755328 “Huawei Phoenix” trademark was published. As per the reports from the document summary, the Chinese mobile maker Huawei Technologies Co., Ltd. Declined to welcome the fragmentary rejection of the trademark registration application of “Huawei Phoenix” for scientific instruments by the Trademark Office and applied for review.

The evaluation on the Applied trademark “Huawei Phoenix” found that it thoroughly holds the cited trademark “Huawei Phoenix” “华凤凰” (“Phoenix”) that accounted for many similar trademarks. The concurrence of use on the selfsame or indistinguishable goods may easily perplex the public’s thoughts. Also, the proof submitted by the applicant was inadequate to prove the applied trademark heavily.

In the wake of the user having created distinctive features and popularity distinguishable from the cited brand, the application for registration of the applied trademark on all re-examined goods shall be rejected. It is worth mentioning, in July last year, the “Meta Service” trademark was used for registration by Huawei Technologies Co., Ltd.

Similarly, on September 15, 2022, Huawei Technologies Co., Ltd. applied for the “Huawei Phoenix” trademark in the scientific instrument category. The active status is under the examination for refusal,  and the current status of a “Huawei Phoenix” trademark in other types has been “preparatory Announcement.”

Moreover, few “Huawei Phoenix” trademarks have been registered. As per previous media reports, Huawei experts delivered a speech in October 2020, introducing Huawei’s Phoenix engine technology. Recently, Huawei applied for the third time for the “meta-service” trademark of scientific instruments. On December 17, Huawei also used the Esh trademark of Yuan Media.
